It’s unknown whether she had the photos taken to celebrate her new implants, which she got this year with financial support from the sponsors of the state pageant.

That’s the timing the organization cited to Access Hollywood.

But a spokeswoman for Prejean said they were taken at age 17 to be used in a modeling portfolio, Access Hollywood said.

In Prejean’s contract with Miss California USA, she agrees not to pose in nude or seminude photos and says that at all times in her past, “I have conducted my activities and life in accordance with the highest ethical and moral standards.”

On Monday, the first topless photo (See cropped version above.) appeared on the blog TheDirty.com, showing her holding her arm across her breast. Prejean was already a hot topic for commentators because she told of her opposition to gay marriage during the Miss USA pageant in response to a question from pageant judge Perez Hilton.

The state pageant organization has not yet announced a decision about what action it will take regarding the photos and Prejean’s title as Miss California USA.

Pageant spokesman Roger Neal said today, according to the Associated Press:

It appears Prejean has run afoul of several sections of the 12-page contract that all prospective contestants were required to sign before competing in the November state contest.

The detailed document prohibits the titular Miss California from making personal appearances, giving interviews or making commercials without permission from pageant officials. In the last 10 days, Prejean has made televised appearances at her San Diego church and on behalf of the National Organization for Marriage, a group opposed to same-sex marriage.

The contact also contains a clause asking participants to say whether they have conducted themselves “in accordance with the highest ethical and moral standards.” As an example, it asks if they have ever been photographed nude or partially nude.

“As you can see from the contract, she violated multiple items,” Neal said in an e-mail to The Associated Press.

    The idiot that asked her a political question at the pageant should be the one in trouble, not her. I’ve seen semi-nude photos like that on the cover of major magazines so she didn’t do anything improper. It’s that mud digger on the pageant judge panel who has violated the rules. Just shows how messed up the pageant world is, and I doubt many people will be interested in these pageants in the future.

    I had no idea that lying when signing a contract that specifically asks if you’ve EVER posed for nude or semi-nude photos was a perfectly acceptable way to demonstrate that you are a “Biblically Correct” person.

        Let’s put it this way, Obama has been asked on numerous occasions to produce (probably a bad word because he really could now) a copy of his birth certificate. He has refused…so this is the part thats intriguing, if Obama is the President with a “transparency” policy which he loves to go on and on about…what’s the big deal about producing a copy of his birth certificate?! We have a right to know who our President is and where he came from. Produce the document, show us all that you were born in Hawaii, like you tell us, then no one will ask again. It seems pretty simple to me.

    The benefit of having no set moral standards is that there are no grounds for someone to accuse you of being a hypocrite.

    The photo isn’t trashy and, if the lady in the photo was someone with a more “progressive” stance being attacked by conservatives, most of you would call the photo “artistic”, maybe even “tasteful”. Who knows if she would even have answered the infamous question the way she did if asked at the time the photo was taken.

    The bottom line is that she answered truthfully and respectfully. She didn’t say anything hateful about gay people, she didn’t say they shouldn’t have the same legal rights as male/female married couples. She simply answered the question, and too bad if some people got bent out of shape over what she said. I could see a bigger uproar if she won the contest, but she didn’t - and likely in part due to the answer she gave.

    I am a Christian man and think Miss California is a hypocrite.

    She says homosexuality is wrong, but she doesn’t mind posing lustfully and tempting teenagers to “beat off” to her. She doesn’t mind exploiting her body, which should be saved for her husbands eyes in marriage.

    Lust is the desire to sin, and it is sad that she doesn’t mind posing semi nakked which I am sure stumbles a lot of men and boys. Pornography is an addiction that a lot of men and boys struggle with. I think she is wrong to pose in such a way that should be saved for her future husband.

Under what circumstances can a person, regardless of who they are and where they came from, human or Christian alien can a being be nude? What constitutes nudity? What is the harm in nudity?     I don’t think the photos I have seen are bad IF you don’t claim to follow the Bible. The issue is not the photos that we have seen (so far) or the beauty pageant or even her view on gay marriage.

    The issue is the way she claims to be following a conservative christian life that affects her views on marriage and then turns around and does all this other stuff that conflicts with that 180 degrees.

    She is also violating her contract by appearing in interviews and in commercials (the NOM ad) without permission. Even some conservative Christians don’t want to claim her, and say she is not being biblically correct. Go read for yourself:

There are many Christians that are on marriage equality side frankly. Straight ones even! So your effort to turn this into a gay vs. Christian issue absolutely fails.

    However, the two of us do hate one thing and that is hypocrisy. So many conservatives want to cast the first stones at gay people all the while doing questionable things that expose the glass house they live in. Does the Pageant want a virgin for the crown? The only thing I don’t like about her is the implants. Obviouly she didn’t have the confident about her body but I think she looks fine before the implants. Hell with the Pageant. If the Pageant wants to yank her title, I say so be it.
